Why is she confident that there will be a vacancy in order to make any appointments?
Assuming for the moment that J. P. Stevens stays on the Court until his 89th birthday in 2009, and then Hillary appoints Bill to that seat, that means Bill will start on the Court at age 63, one of the oldest appointees.
I guess the good news will be that he won't be able to stay on the Court for very long.
I wonder if Bill would be any more "activist" oriented than Stevens has been? I would HOPE that he learned a powerful lesson from the Bush v. Gore decision, but it doesn't appear that any liberal has really learned anything about the evil of activism.

I don't think it would fly, though. After JFK named his brother Bobby as the Attorney General, I believe rules were passed to prevent this sort of nepitism.
