Rape is rape and it's a violent act. Rape is a crime. NO ONE has the right to treat another human being that way! It's abuse, and done within a marriage it's a betrayal of gargantuan proportion. It's a huge violation of the marital vows that cannot be undone. The penalty should be the same as it is for all criminals that rape, they should serve jail time so they can sit and ponder the fact that they broke the law and that they're a dirty rotten, low down, no good criminal.

What's with all of this "he" garbage, as if the woman can't ever force herself on the guy, or doesn't?
Being in a marital situation you have already given some consent to being with the person sexually, as you have concerning other matters. Therefore if your partner did indeed rape you it would have to be beyond any supposed existing consent, and the penalty should be whatever is given to rapist as it now stands.

That charge usually comes with violence of some sort, so it would be a felony. If there is already a restraining order it would amount to more charges. The penalty would include jail time, but that would be up to the individual state, and the judge.

my (now ex) raped me repeatedly when i asked for a divorce.
knowing that i had to have therapy & was suicidal from being raped previously. so, imo, it was *worse* than regular rape.

The penalty should be the same. Married people think they have the right to make their spouse do what they want, they can't be more wrong. Call the police, have them arrested, and go through the trial just like everyone else. They should have to pay from the crime they committed, not only did they do The crime, but they deeply corrupted the heart of the spouse.

I think depending on the severity of the situation. Such as for example if they brutally beat the person to the point where they kill a person. They should get death penalty. If it is not as bad (but then again no matter what rape is rape so its all bad) but if its not as severe then at LEAST life in prison and by life i referring to what they call life 21 years or something

well whats the sentence for rape? it should be the same. isn't it 40 years? I don't know, but I think marital rape can be in some cases worse than just rape... but that's just my opinion.
but it should be a bad punishment! rape is way too common.

Rape is rape, regardless of who does it. Spousal rape should be a crime punishable as any other rape case. Those who think otherwise must believe a woman is a man's property to do with as he pleases. It sicken me to hear about it.

Grounds for divorce and alimony?
I think criminal penalties would lead to abuse in the system. But would it apply if a woman raped a man(say they were drunk and unconcious)?

The same as all the other rapes. Rape is Rape, it doesn't matter how or why. I think the penalty should be a little worse as how can you do that if you love the person.
