She has had a virus every other week, with fevers, vommittg, wheezing, etc. My daycare said that Bush passed a new law... But I dont know of anything besides the family leave act. I am pretty new here and am on a 90 day probationary period. Theu just gave me another 90 days of probation though, so they are giving me another shot to get it together. But I have no one to care for my daughter if she keeps getting all these illnesses from day care. HELP!

Thanks guys...That is what I thought, but daycare insists that they cant. I dont know where they got this from. I really appreciate it. Frankly, I dont care if I get fired or not, my daughter comes first! There is really no one I can trust at her age that can watch her, at least not until she gets older.

Quiet simply yes they can, and if you have just been put on another 90 day probationary period then they are not willing to take you on permanantley at this moment in time. You are lucky they didnt just terminate your post within the first 90 days.
You have been given a second chance which indicates to me that when you are at work you are obviously worth having around other wise they would not have troubled them selves with another 90 day probationary period.
Dont you have friends, family, a partner her father who could help you?

EDIT: Vixxen if you can do with out the job, why dont you explain your situation to them tell them that your absence is not intentional but youre daughter comes first and for the foreseable future you are leaving to take care of her.
They will appreciate your honesty and may have a vacancy for you when you are in a better situation if not a vacancy then a favourable reference.
If you can not do without the income it may be worth talking to them and explaining your situation. Some employers are more understanding than others.

Unfortunately, they can, especially if you are on probation. In their eyes, you are not showing yourself to be a reliable employee, which is what they need. Even if the time off is without pay, it does hurt the company a lot more than the money they save by not paying you. I've known people that missed too many days because their car was a piece of crap, and they had no way to get into work.

My only suggestion is, if you haven't already, take your child in to see the doctor. There may be something more there than just catching the latest virus every week. She may have allergies to something at daycare.

Yes you can. Is there nobody you can trust and afford to bring into your home instead of taking the child to daycare where she'll get every contagious disease the other kids have?

Yes, they can fire you. In fact, since you are there as a probationary employee, it's not even "being fired". It is a simply matter of them not permanently hiring you.

Yes. You were hired to do a job for the employer. If you are unable to do the job, they don't need you. FMLA is the only law I am aware of for family illness.

Yes, you can be fired for missing work. The fact that your daughter is sick is YOUR problem, not theirs. You are not meeting your employers needs and they can fire you for it.
