In what instances is it legal and illegal?

If I have the money to buy many Super Bowl tickets and sell them for 500% of what the face value is, it is considered illegal.

But Hannah Montana tickets are not? There was this man near the entrance, where I took my niece to watch the show, the value of the ticket was $25(back seats) but he sold for $130-$160 and people were buying them.

Is there a price range for it to be consider illegal, because of the greedy government?

Laws governing ticket scalping differ from state to state. What is legal in one state may be illegal in another.

Depends on the jurisdiction and to a large part the venue and the promoter.

Many if not most major league sporting events are working VERY hard to tie a ticket to a person to prevent resales at all, even at face value unless you go through their channels.

Not completely there yet, but don't be surprised when you notice it.

In some places, it is illegal to sell tickets within a certain distance of the venue at all , and in some others, for over face value.

If demand for an event is high enough, then a group of scalpers could simply buy as many tickets as possible and force real fans to pay a huge markup just to get into the show. One thing that's been done to counteract this is limiting the number of tickets that a single person can buy. I'm sure that just selling a couple of tickets wouldn't get you in any trouble, but selling them for double the price might not be the best thing.

Depends on the state. Some states don't have laws against selling tickets for a profit, and other do. Most don't allow it on the premises of the event, but if you go a 1/2 block away, it's fine. Some states even have ticket brokers that are registered with the state and regulated.

Depends completely on State law.

Some States have anti-scalping laws, some don't.

Even in those that do, enforcement - especially of sales online - is typically very lax. Enforcement, if any at all, is usually limited to 'obvious' offenders - the guy standing outside the concert hall yelling "Get your tickets here!"

I think you'll find scalping is illegal in most states. Just not enforced very well.

Scalping is illegal.....they just don't enforce it.
