One day my wife cleaned out all my accounts and left the state. I spent $2000 to get a restraining order to prevent her from spending the $30,000 (+). She violated the restraining order and the courts DID NOTHING. Since the state I live in is a mutual property state, they gave her half of everything. She kept the $30,000 (+) and I got to keep my life insurance.
If she hides the money, there is no guarantee you will ever see a penny. Good Luck!

It doesnt matter when she got it before or after you were served. I got paid the day that I left my husband and withdrew the money for me and my kids. The judge made me pay back half of the money I took out to him in the settlement. Also the overdraft fees that were aquired when he paid bills and bounced checks. He would never put his money in the bank and pay bills with mine.

if she took the cash before she was served, your lawyer is correct and you are screwed. if she did it after, you may be able to recover 50% (dependent of course on where you live), but the battle will take forever. unless you are talking a huge sum of money, you may be better off to just forget it and move on. ex's by the way tend to do that sort of thing :)

Sorry but as long as her name was on the account she had every right to use it.You should have thought about the joint account as soon as the two of you split. It should have been divided and the account closed.Too late now.

Tell the Lawyer that was his fee she cleaned out of the bank, then maybe he'll think of something.

You should've cleaned it out first. It's the first thing I'd do.
