n accordance with the FBI definition, statutory rape is characterized as non-forcible sexual intercourse with a person who is younger than the statutory age of consent. The actual ages for these laws vary greatly from state-to-state, as do the punishments for offenders. Many states do not use the actual term "statutory rape," simply calling it rape or unlawful sexual penetration among a variety of other titles. These laws rarely apply only to intercourse, but rather to any type of sexual contact. Dating someone without sexual contact cannot be considered a form of statutory rape, and is almost never illegal. ...This age varies from 14-18 in all states in the USA with over half the states adopting the age of “16” as the legal age of consent. ...

Depends on where she got pregnant. Here in California the age of consent is 18. If the minor is more than three years younger than the adult then it is considered statutory rape. Since he is 19 he just barely made the boat. I'm not sure about other states.

Wow!! Who cares! Seriously...there are so many pregnant 16 year olds (teenagers). The only thing that makes poor Jamie Lynn Spears stand out is that she's famous and oh no! Britney Spears' lil' sister. You know what, she can have good morals and still get pregnant...the girl has money and unlike many teenagers, she's got the means and the money to take care of this child.

Why are parents concerned about what she's teaching their daughters that watch her shows? Jamie isn't and shouldn't be teaching your children anything, the parents of these children need to be teaching and making their kids aware of the tremendous responsibility it is to become sexually active.

It's Jamie's personal life, what she does in her life shouldn't be anyone's business but hers. It's so sad and I wish people would worry about themselves rather than what other people are doing.

It is a state by state issue. If they are in California, yes he can be charged for stat rape. If he is greater that 3 years older, i.e. is he turns 20 before she turns 17, then it can be filed as a felony, and a GBI (great bodily injury) could be added to the charge. Under California law, a felony stat rape, getting the girl pregnant is GBI.

If it was two 16 year olds instead then it would be statutory rape, too, but nobody seems to consider that when it happens, which it does all of the time. What it comes down to is if the parents don't wish to press charges then they are basically giving their consent, and at 16 she is allowed to have sex with the consent of her parents.

Yes he is.

In Louisiana, where they live, sex between a person 19 or older and a person between 12 and 17 years old is called "Felony carnal knowledge of a Juvenile", and is punishable by a fine of up to $5,000 and/or up to ten years in prison, plus sex offender registration.

If the DA decides to charge him, he's in DEEP do-do.

According to Louisiana law (I believe that is the proper jurisdiction) it states that this incident is:

A. Felony carnal knowledge of a juvenile is committed when:

(1) A person who is nineteen years of age or older has sexual intercourse, with consent, with a person who is twelve years of age or older but less than seventeen years of age, when the victim is not the spouse of the offender.
