and they queue up and have meal and the 'offer' for 2 for 1 is no longer valid what do they do? Would this be an invitation to treat or an offer? Thanks legal people...

If they took down the offer, and you missed it, then you are stuck. They have no duty to tell each and every person that the office now void. It is just life.

A 2 for 1 offer in a restaurant is not an offer to purchase a meal but an invitation to treat: Guildford v Lockyer (1975) Crim LR 236. The situation would be different, however, if a reservation had been made beforehand. The offer is accepted when the reservation is confirmed if the terms of the reservation are specific enough.

Businesses reserve the right to remove specials at any time. They set the price. If you don't like their offerings then you go elsewhere. That's the beauty of capitalism.
