Don't you think that someone who owns a resteraunt or a bar should be allowed to decide for themselves what they will or will not allow on their property?

I mean seriously, it is a non smokers choice as to wether or not they want to spend their money at a place of business which chooses to allow smoking

Yes I do. Pretty soon they will pass a law that you can't smoke in your own home!!
Yes Americans need to stand up and fight!!! We usually just sit by and take it

From an employment law point of view, the employer should furnish a safe working environment for the employee, if that means a smoke-free environment. I agree with Dan.

From a public health law point of view, the government has the right and responsibility to step in when they think a product is adversely affecting the health of their citizens. So if they believe that banning smoking in bar and restaurant will improve health of their citizens, they can rightfully and legally do so.

On the other hand, where are the rights of the owners of the restaurants and bars? Sure they have the right to decide what to do on their private property, but when you open your business to the public, then the public health law argument trump your private property right argument. This is like nuisance law. Just because you want to pile trash on your front lawn doesn't mean the city can't ban that to protect the health of other residents.

This is different from banning smoking in your own home, because you are not doing business and inviting the public into your home as a result, so the public health argument does not apply.

This law should have been put into effect along time ago. This way the restaurant or bar owners wouldn't even feel the difference. Yes I agree the bar and restaurant owners should be able to make their own decisions for their business. But that's the Government for ya always dictating what we can and can't do. I live in Ontario Canada and we have had this law passed for about 10-15 years now, and there is a $5000 fine if caught. I think everyone is adjusting, but now there even restricting smokers not to smoke near the buildings outside!! Now that to me is a little too much. Why bother selling cigarettes at all, pretty soon you won't even be able to smoke anywhere outside in public, now that's not right after getting everyone addicted after all these years.

No. Smokers are in the definite minority now (US), and shrinking every year. There are definite and proven harmful effects of second hand smoke and being cooped up in a building forced to breathe that in is harmful.

Customers can go elsewhere, but employees cannot. US law makes many laws to protect the health of workers and this is simply an extension of those laws.

Canada may be different because more people smoke there, but in the US, very few restaurants and bars have actually lost business because of a smoking ban. There are many people who didn't patronize those businesses because of the smoke, who now go. They lost some customers, but replaced them with new customers.

Since many politicians are not to bright to begin with, but just smart enough to realize they have to do something to make people think they deserve their ridiculous salaries they come up with these stupid rules and regulations. Also far too many of them are firmly convinced that the average Joe or Jane are too stupid to keep from running into a brick wall head first so they pass a law forbidding people to run into a brick wall head first, and there you are - it's all for the good of the people.

Dan is correct!!! It is employees that need to be protected since they are exposed for longer periods of time than customers.

in Canada bar and restaurant owners lost so much money because of this law its not right and a shame. and there is nothing that can be done
