Yes, you have to disclose that.

Anything out of the norm that is hidden that you are aware of, regardless of what it is, you have to disclose.

PS: Not sure where everyone is getting this "depends on state law" jazz...in EVERY state, when dealing with real estate...it must be disclosed b/c it's hidden.

Answer is always..."It depends!". Where do you live? States and localities always have different rules regarding such addendums. Contact your local NAR or state government for more information.

Whether it is required or not will depend on your state law (statutes, regulations and cases), but it is certainly a good idea for both the seller and buyer, especially if there is one or if the seller is not sure there is one.
