Returned item which was obviously used but being sold as if it were new. Was told to get a new product and so went and took 2 boxes from shelf. Started to open boxes in front of them to ensure that products were new.

A lady standing next to cashier, ordered me in a very rude tone that I had to repack what I opened. I was in a rush and didn't like her tone, plus I thought that sort of stuff was what they were paid to do, and I told her so. Then it escalated into a war of words, with her trying to say that she was lp and that I had to leave the store, and I refusing to leave until I got what I came for. I said I was going to complain to her manager, and take her picture and put it on the net, and she said that that wasn't legal and she was going to have me arrested.

Finally a supervisor came, enabling me to complete the return. But as I started to leave the lp laid hands on me and pushed me out, insulting me. Other lp male made threats of violence and insults. They crossed the line.

The war of words that ensued started off with me calling attention to her rude way of addressing me, as if I were a slave. I said that if anyone was the slave then it was her since she was an employee of a store where I was a customer in. Then she tried to get all authoritative and told me that I had to leave the store. I proceeded to chew her out loudly in front of all the customers. I am guilty of using 4-letter words. I won the shouting match, and continued to wait for higher authority. In the meanwhile, her hurt ego wouldn't let her mouth stop talking, saying lies like she was going to put me in jail, and I just kept telling her to put a sock in it.

When supervisor came, lp tried to play race card by implying my calling my remark about slavery was a racial remark against her (she's black), but I cleared it up that it wasn't.

I asked her for her name, but she wouldn't give it to me, and I don't have the name of the other male lp. Heard I need these in order to get DAs attention.

Wow! You need to find out who the district manager is, not just that store manager, this is rude, and certainly uncalled for behavior! What ever happened to the old cliche, the customer is always right!! And in this case, you were!~

It isn't just WalMart. While the treatment you received defintely crossed the line, I am finding more than normal rudeness among employees at other stores as well. I could name 3 places I went to this week Christmas shopping, and you would think the clerks were doing me a favor just allowing me to shop there. By the way, the other stores I shopped at, not including WalMart; every item I picked up said "Made in China". But it is always WalMart singled out that they cater to the Chinese. If you think you have a case, go to the authorities. After all, McDonald's was sued over a hot cup of coffee, and a dry-cleaners over a lost pair of men's pants. With all the lawsuits, it is the lawyers who really profit. An escalation "into a war of words" requires at least two parties.

all parties were wrong, including you. You can't treat someone's rudiness with rudiness and expect to be treated as if you are right or as if your special. Although she never should have told you off or cursed at you, she isnt paid for repacking things. and you could have simply ignored her request to do so. the lady probably gets paid about seven dollars an hour, and a t the rate many would not go out of their way to be kind to a difficult customer. Youll waste a lot of time, energy and money hiring an attorney for such a stupid reason. Get over yourself, just don't go back.
Also since your threated her with a photo on the internet, it could be well justifed that they forced you out of the store.
You will not win any money or get a settlement of any kind (a judge will prob dismiss)

It's too bad you let this situation elevate to this level. You were told to get a new product.You should have taken the product to the return counter and opened it there. It's not the employees fault you were in a hurry. You behaved rudely to begin with and didn't like rude behavior directed at you. Being in a hurry ended up costing you more time than behaving responsibly. You all over reacted. Just drop it.

confident, yet extra often than not with purchasers- stealing, attempting to get refunds on rubbish, complaining approximately no longer something. It wasn't that undesirable working there, yet i'm no longer a human beings guy or woman, so I relatively hated it. the only concern I had internally is while there have been no longer adequate human beings scheduled again in (automatic time table), or the staff purely desperate to provide up that day, and the lines have been subsidized up and all of us replaced into staring at me as a supervisor like I did something incorrect. I had some exciting working there nonetheless. For a guy or woman who fairly likes interacting with human beings, it would be a advantageous place to artwork.

I believe that when you started to leave and there was a laying on of hands, that opened up a charge of assault and battery. However, as this was a business dispute, there will almost certainly be a he-said, she-said situation. Assuming there is a way to prove your narration is accurate, you have a case. But the really big word there is ASSUMING.

Unless you an subpoena any video tape from the security cams before they wipe it, you might find that you have no good evidence. I.e. on principle a good case; in practical terms, no case at all.

Ooh. ouch.
I'd say with this one, be happy with the return and try and forget about the whole nasty situation. Suing can get complicated (and costly), and Walmart's gonna go to huge lengths to make you look bad and keep their money. Besides, I think that sort of thing is better left in the past, rather than focused on for ages.
Kinda sucks, I know. But with horrible people, there's only so much that can be done...

yes they did you should protest but sue them if you must but you may need proof from a witness etc otherwize it will be your word against theirs, it is unfair but it may be said that it was not the shop asistants job to repack the item as well so all things being equal make em sufer dont shop there much or protest outside of store tell anybody who will listen

yeah. Wow. It's not Wal-Mart's fault, its obviously the employees faults. And yes the customer is always right. Jeez talk about bad customer service. Get an attorney.

Why dont you just repack it? You got what you wanted, so are you just gonna leave a mess just because you're in a hurry?
