One was drunk while driving
One was chatting on a cell phone while driving
The pedestrian dies.
Statistics show that talking in a cell phone creates a similar impairment to driving ability as does a drunk driver with .1
The drunk goes to jail for 10 years, the person talking on the cell phone goes home that same evening.
Does this seem right to you?

Talking on a cell phone is illegal while driving in my state.
And if you insist, the pedestrian was a 80 year old sober grandmother in both cases (not that it matters)

So, the real question is how drunk/stoned was the pedestrian? If we can show just cause why either one of the drivers hit the pedestrian they're both off the hook. Talking on a cell phone is a distraction, but one that's legal. It is not legal to drive drunk. It's also illegal to be publicly intoxicated - so...what about the pedestrian?

No they should ban cell phone conversations while driving, anything that impairs your ability to operate a motorized vehicle should be criminal. Cars are not soft you know.

no it doesn't seem right, but try and change the system. How are you going to enforce the NO CELL PHONE law, everyone has one and they talk on it constantly
