Yes, actually it IS illegal, unless they say it's okay, but you know... it's just not a big deal, and most people don;t know enough about their routers to check up on that kind of thing. If they did, they would certainly secure it better.
Theft of services technically though.
In the end, you can just manually disconnect from their network once, and the computer won't auto connect to that ssid anymore.

I don't think it is because they do not have it a secure network. You might talk to your neighbor about securing that network.
If you don't have a wireless router, but you already pay for internet then turn off your wireless card.

It probably not illegal - but it is perhaps unfriendly - it would be slowing them down and possibly causing them extra charges or shaping. It would only "kick in" if you have connected to it at some stage.

Well technically, if you do it without his consent, it is not legal since he didn't give you authorization to do so.
However, it's his responsibility to protect his connection and if something happens, that's not your fault but his.

ITs illegal, its like tapping into someones gas/water/electricity/cable connections. i think its a form of tresspassing and a breach of privacy since you can access his network files, use your neighbours printers , etc ...

It's not illegal as long as it not security enabled.Which means it has no password,so your fine.
You can however tell you computer to onnect to it manually,instead of automaticaly.
