I moved into an apartment with three guys. BIG mistake (I'm a girl). One of the guys is very irresponsible, immature, loud, inconsiderate, never cleans up after himself and talks crap about everyone he knows. And his excuse for how he acts is, "that's just who I am, I know I'm an a$$hole"

But anyways, he was always putting me down, making fun of me, telling me everything he thinks is wrong with me, and just recently he said he "has some friends he can get to kill me"

Well, I decided I've had enough of him. So, I packed all my things and I moved out of the apartment the next day. So here's my question:

My name wasn't on the lease (because I'm 20yrs.old). I never signed any papers about anything for the apt. Can this guy sue me because I wont pay the remaining of what the lease is? I'm going to pay the rest of Decembers rent, but I'm not paying up until April, because my name isnt on the lease and I'm not living there anymore.

So, can he really sue me for that???

Also, I paid all my rent in cash. Since it was split up between 4 people. So there were no checks written on my part. Just cash.

Oh yeah, We moved in November 7th and I moved out December 17th... I had told them about a week or so ago that I was probably going to move out.

I said I was 20 yrs. old because you have to be 22 yrs. old to be on the lease. So, yes it does matter that I'm not old enough to have been on the lease

I strongly disagree with the responders who said that your former roomate can sue you. Actually you have a good lawsuit against him.!!!!

I think you also have a good CRIMINAL case against him as well. This jerk is guilty of domestic violence.

When he told you that he can get some people to kill you, that was a death threat. That is a VERY SERIOUS CRIME.

Also he made it extremely unsafe for you to live there. You had to move out for your own safety. He did not leave you any other reasonable option but to move out once he made that death threat against you.

When he made the death threat against you, essentially he evicted you from the property.

Not only that, but he evicted you without the notices required by statutory law and in violation of any agreement that you may have had with him..

You have the right to sue him because he made this a very unsafe place for you to live because of his death threat against you.

He breached any contract that he may have had with you, verbal or otherwise.

I not only recommend that you sue him, but that you also report the death threat that he made against you to the police.

This guy not only needs to be sued by you, he also needs to be in jail.

I know that some of the other responders think that he can sue you and win; Actually the opposite is true. You can sue him and win and you also can put him in jail.

I have a little more experience in these matters than the other responders. I am a landlord myself, and I have been a landlord for over 40 years.

Ok, the LANDLORD cannot sue you because you did not sign a legal contract....that deal ends there.

However, your roommates can sue you because you did live there, they can prove you lived there, it was a living situation and not a domestic one...therefore you had a verbal agreement.

If you have ONE piece of mail that arrives there after you leave, or a single utility in you name, or witnesses...any of that is proof that you lived there and will fully support the verbal agreement in court.

You owed them a 30 day notice under a STATUTORY lease agreement with your roommates (that is a lease by operation of law that takes place in the absence of a written one).

They can sue you for not only missed rent, missed utilities, and rent for every month (usually up to about 3 months) that you were absent, because those were reasonable expectations of a roommate.

I can assure you if he sues, he will win.

PS: Being 20 years old is not an excuse...you are over 18, a legal adult, therefore, that doesn't get you off the hook at all.

He can try but I doubt he will win. You are not on the lease, you didn't sign any rent agreement and reason for moving was your safety since you were threatened by another roommate. So don't even worry about it. I wouldn't give them another dime unless they are friends and you want to keep the friendship. Then you should at least pay your part of the utilities.

So this guy is a creep. Tell him to go to hell. He can't force you to pay without a court order. If he takes you to court no judge will make you pay because your name is not on the lease. You can also tell the judge he threatened to kill you, if you have a witness, and you think he should be punished for that and other things he did. If you play your cards right you may get some money back because he made your life hell.

Anyone can sue for anything, but the question is what result he will obtain. Absent a written agreement, he's going to have to convince a judge that you had a verbal contract, which is not an easy thing to accomplish. However, if he has any copies of your cancelled checks which indicate 'rents paid', he now has some visible evidence that there was, indeed, a verbal contract entered into.

I'm not a lawyer, but they might try to pull verbal contract on you. Might depend on the state you live in on how hard they'll get with that. Being that you never signed anything, I'd think you'll be in the clear.

You didn't sign any papers, you don't have any responsibility for the rent since you moved out.
