I want to sue my ex employer for trying to send me to jail for 3 yrs and they did lie on the witness stand, I need my time card records ..all the records are thru a third party ...a pay roll company ..I called the payroll company and they wont deal with me ..so how do I get my records thanks...

All you need to do is send a letter of request with proof of identification and reference in the letter the Freedom of Information Act. You DON'T need an high priced attorney for that. Additionally, YOU can subpoena the records yourself if they give you a hard time. When you mail your request send it REGISTERED as they only have 30 days from the date of the letter to comply.

Went through this with a local company with some employees who were filing claims with the EEOC. The payroll company wouldn't even talk to the employees. I drafted request letters for them and they ALL got their records, IN TIME.

Have you ATTORNEY subpoena the records. You have the legal right to the records, but the payroll company is probably not allowed to give them out without legal paperwork.

Get an atty and see what they can do to get these records. He may have to get a court order to have them released. You are going to need a lawyer anyway to sue.
