Maybe you could get some of those glasses with eyes in them so you could look like you're awake even if you're not?..

Any time you are in the public domain, and do not have an assumed right to privacy (like in a bathroom or something) it's perfectly legal for someone to take your picture.

Yes, if you were, for example, sleeping at your desk.

If you have a 'private sleeping area" (such as people like doctors have on night duty) then no, he can't photograph you there.
