I have a condo in Florida in Broward County and Tenant hasn't paid Dec. We have their security deposit they gave us. Their lease ends January 6, 08. Should I file a small claim and do I have time so they can get served before they leave?

They may be assuming that the security deposit is to be used for the last months rent (assuming the amount of the security deposit will cover the rent.)

Give the tenant a 3 day notice to pay or quit. This must be done before you can do anything else.

Are you sure that they are going to leave?

You can either start the eviction process due to non-payment or wait until they move out and sue for the rent owed in Small Claims.

In Oklahoma, you need to give the person served 7 days notice before the hearing, so you need to hurry.
