It's very difficult to file bankruptcy without a lawyer. You can do it yourself but the laws are complex and you have to know what you are doing. If you make a mistake you can get into serious legal trouble.

It is possible, yes. Is it advisable? No. If you can't afford a lawyer, you probably shouldn't bother filing yet either. The cost of an attorney should be significantly less than the actual cost of paying off your debt. If you want to be sure you are doing it right you really need an attorney. It isn't easy for someone that doesn't deal with bankruptcy regularly to know for a fact they are doing everything correctly. The peace of mind you get by having an attorney doing the work for you is worth it.

You should be able to go to the court house and purchase the package of documents you will need to fill out for about $50. Then make an appointment with the legal aid office and have them look over your documentation (fees are based on income). Be careful and thorough, this will save you money but could cause you a lot of problems if you don't follow all of the rules exactly. You could also look for an Attorney that will take payments. I know there are some advertising in my area all the time.

My advise would be, NO. Way too many new laws! I would try everything I could to avoid Chapter 13. It seems people who file Chapter 13 find themselves in even greater debt then before they filed! If you can file Chapter 7. Do all the research you can first!

There are forms at places like OfficeMax or Staples that tell you how to file for yourself. These should be pretty self explanatory. Wish I had done that, my lawyers fees were 2500 and could still grow for a basic file, that i probably didnt need to do.

In my state, the filing has to be done electronically now, which an individual wouldn't be able to do.
