should Congress and the Senate be held accountable when a President does this?

As when Lincoln suspended Habius Corpus during the War between the States?

The Short Answer is NEVER.
Yes Congress (The Senate is part of Congress, along with the House of Representatives) should be held accountable, as only the Congress can remove a sitting President through impeachment (excepting a president can be removed during the regular election cycle).
But seeing as Congress in never held accountable for any of their other failures, how do you really expect Congress to be held accountable for failure to impeach?

Is not okay for president to ignore our Constitution or rewrite our laws. The checks and balances system is in place to make sure the three branches of government work in cohesion. I haven't seen this working, much lately. Fear is a powerful ally, one that makes people give up things, like their rights. The right person in a position of power can manipulate the situation using little more than fear. I honestly think that is what has been done here. The Congress and the Senate should be held accountable for keeping the executive branch in check. I see the fault for our situation not lying with just the executive branch. But with our senators and congressmen as well. That is why the chief executive is limited to only two terms. Giving us a chance to correct the mistake.

Never OK to ignore it, however, practically speaking, it may be in the best interest of our country for him to do so on occasion.

For example, if the courts or legislature ignore or violate the constitution, he may be wise to make a counter move.

Think about these: NY state passed a law allowing gambling casinos to remain open even though they violate the state constitution; The US Supreme Court decided to "legalize" abortion based on a right to privacy that is not found in the constitution.

I know I have not given you a specific for-instance, but hopefully the above will shed some light on why we ought to have law in the first place.

Part 1: No it is not OK and has never been done because the President cannot re-write a law, all he can do is sign or veto a law passed by congress.

Part 2: Since part 1 cannot happen, part 2 cannot happen either.

It's never OK, and it can't be done.

Also, the President does not re-write laws, the Congress does.

The check on the President violating the Constitution is the Judiciary, not the Congress.

contrary to popular belief, the president can rewrite some laws that are regulated by the "executive branch. However, only congress can change the united states code, which promulages most federal law.

As much as you would like to presume, President Bush (nor any other President for that matter) has EVER done this. If there is any branch that re-writes laws (other than the legislative branch which is supposed to) it would be the Judicial Branch (see Roe vs. Wade, not to get into an abortion debate here though).

The President, by law isn't not allowed to do that. Unless of course, you are GWB and you exploit 9/11 to your advantage, brainwash your Constituents and citizens...then I suppose you can do whatever the hell you want. One thing I know for sure is, the President cannot get head in the Oval Office.

The president can't do that.

The presidency is the Executive Branch not the Legislative Branch.
