social security by law can not be garnished by anyone but s.s.i. a bank took 30.00 over draft out of my s.s.i. HOW???

banks do what they want, most likely you will have to go down to the bank, show that the only monies from the account come from SSI, and demand the monies returned

They didn't take it out of your SSI. You put your SSI money into your checking account, and they took the $30 out of your checking account.

All the ban on garnishing SSI does is stop a creditor from having the money taken out of SSI at source, the way they could out of wages. Once the money's in your bank account, it's fair game to anyone.

Overdraft is not garnishment.

Garnishment can only be obtained via a court order.

Overdraft charges are a policy created by the bank (in conformity with banking regulations of course).

You may have success speaking to the bank however. I do know that some exemptions do apply to disability payments.

They took money out of your checking/savings account. Not actually out of the SSI check itself. You are still responsible for debts you incur. There are 5 standard reasons a SSI check can be garnished. 4 are for taxes and one is child support.
