Question regarding 2nd violation of Probation for DUI. This is my second violation, first violation occured 5 months ago for not reporting. I went to court and the judge reinstated probation. The only condition I have left is DUI school, all fines, community service, vehicle lock and MADD classes have been completed. Only item missing is the DUI school. I am scheduled for school in January, however my court date is tomorrow. What should I expect? Cannot afford a lawyer at this time..

Reason for not taking the class is becuase of illness. Just released from the hospital after 10 days last week.

Try to document your illness with a doctor's note or something if possible. Also have with you some kind of paperwork showing that you've signed up for the DUI class. The judge will understand.

You need to bring proof that you are enrolled in January. If you havent paid the tuition yet, do so TODAY. Get a receipt showing you have paid, and take it to court with you. (A judge may be more understanding if he knows you have paid for the course. It shows you intend on attending).
Having a good reason for not having enrolled previously, would be a good idea.

Take the release from the doctor and the assignment date info for the class; hopefully the judge will let you finish.

Bring your hospital paperwork to court and show the judge and ask for more time. thats all you can do and hope for the best.

Expect to have to serve your sentence, hope for mercy since you've demonstrated everything else and you're scheduled in short order.

I had an Uncle who was killed by a drunk driver. I feel no pity for someone dumb enough to drink and then drive. Please learn from your mistake and don't ever do it again.
