Can the people you are paying to still sue you for full payment?
We have been paying off a hospital bill at 125.00 a month and they are threatening to sue. Can they legally sue us? We live in Arkansas.

We have been paying on this bill evey month without fail for the last 5 months.

Unless you have a written agreement to pay a certain amount per month AND you are paying the agreed amount, you ARE in default and they CAN sue for the full amount. That said, if they actually believe you are paying all you can, most creditors will not actually sue.

This is true in EVERY state in the US. The belief they can't sue as long as you are paying anything is a MYTH.

That can't sue you if you if your making faithful payments. If you can't pay the whole amount at once then they don't have a choice to except your monthly payments, I wonder if there is an error somewhere that they overlooked, it happens sometimes or maybe this is just normal procedure for them to follow through, that way if you don't pay it there will be a warrent out for your arrest. So maybe they have to do it legally, but they will see that your making payments and they will just leave it at that.

I don't know about Arkansas, but in Washington state they can't, altho they threaten but as long as you pay theres nothing they can do.. I have been paying on two for three years..untill this country wakes up about health care costs thats the way it will be and for a long time..
