This girl gave my bf the keys, but because she is not the owner, her mom is putting charges against him. So, being charged as a youth, what's the worst he faces?


And he shouldnt be driving right now, susupended licences

his sister said that they told the judge, but because the girl is not the legal owner, they said he is charged for stealing the car..... Please help mee, so wht really is he facing?

There is not enough information here. You say he is charged as a "youth." Do you mean charged in juvenile court? If so, he has an attorney appointed to represent him. If he is an adult, then he should be represented (if he cannot afford counsel, an attorney will be appointed).

It is difficult to predict what might happen in juvenile court, except that he will not go to jail because juveniles are not sentenced to jail.

This court be charged as either driving without the owner's consent (VC 10851), or grand theft--auto (PC 487). The punishments are the same. If he is an adult, it could be charged as either a misdemeanor (with a one year jail maximum) or a felony (with a 3 year prison maximum). However, it is unlikely that he is looking at anything near the maximum. There is no such thing as a "class C" felony in California -- or any other class for that matter.

The case MIGHT be defensible. If the girl had the keys, she might have had apparent authority to consent to somebody else driving the car, which would relieve him of criminal responsibility. Of course, if she was too young to have such authority, or he knew she did not, there is no defense.

His bigger problem, long term, is driving while his license is suspended, which is going to result in a much longer suspension.

He is facing charges of UUMV (unauthorized use of a motor vehicle). Depending on his re cored, and the exact circumstances he could be facing a class C felony. If he has no record, probation. If has been in trouble with the law he could get up to 5 years. Although he would have to have a history of car theft to get the max time. Good luck.

First off, he didn't steal it if the girl backs up his story that she gave him the keys. The car was in her care at the time. Her mother cant say he stole it if her daughter gave him permission to drive. I don't live in CA so I don't know what the min sentence would be if he did steal it. In my state (PA) its an automatic year suspension (additional to what ever he already had) min for driving on a suspended license.

I think he'll get probation unless you aren't telling us about his rap sheet, but really he's at the age now where he has to get his head out of his butt and stop doing this silly stuff.

We don't know of course, why his license was suspended in the first place. If it was DUI or another car theft, he may be looking at the bars for a little while, yeah.

Sometimes courts suck, but usually they use common sense. If he hasn't done this type of thing before, he will probably just get "driving while license suspended." Likely he'll get probation and further suspension to his license, but I highly doubt he'll see any time behind bars. He needs to learn to keep his nose clean, 'cuz when he turns 18, crimes stay on your record. Good Luck!
