Some of our beloved Congresscritters a while ago changed the law so that companies selling "nutritional supplements" don't have to prove that they are "safe and effective" before selling them. Instead, you can sell any snake oil you want to, until the FDA can prove that it's actively dangerous.

Unlike drugs, even if testing proves that a "supplement" does absolutely nothing, you can still legally advertise that it does, so long as it's not dangerous.

No, it does not fall under their purview yet because it's marketed as a nutrional supplement.
