Here are a couple of links, you decide. My opinion is that if you connect to someones network without permission, in all 50 states and Canada you did break the law. There have been arrests made and fines assessed. So you make your choice.

N.Y. Penal Law § 156.00 to 156.50
§ 156.05 Unauthorized use of a computer.
A person is guilty of unauthorized use of a computer when he or she knowingly uses, causes to be used, or accesses a computer, computer service, or computer network without authorization. Unauthorized use of a computer is a class A misdemeanor.

I don't have any idea how you would use an open Wifi connection without connecting to someones network? Nor how you would use any bandwidth without using their computer service? And if I read the NY law, it doesn't appear to "GRAY" now does it? Nearly all states are very similar.

I suspect your legal fees to defend you and prove you didn't violate the law would take all the fun out of it anyway. Just use those networks you know are public and free and you don't have the problem!
