my husband and i have been seperated for almost a year.... i gave him the divorce papers almost 2 months ago.... how do i get him to fill them out??? i know he's just stalling for as long as he can.. i don't want to get ugly about all of this, but i really need the financial help from him??? i'm trying to make this divorce as civil and painless as possible so we can remain friendly around the kids...

you don't make him do anything; talk to your lawyer

In the state where I live [I don't know about yours] you could go to the Department of Human Resources for some advice and probably some help. Lawyers are expensive. I would also check the telephone directory and the internet for some free legal help. If you need financial assistance I would go to a lawyer as a last resort.

Forget about civil and painless, he is already trying to cause you pain by not signing the papers and getting back to you. Call your attorney and do everything through your attorney. There are very few people who can go through a divorce civil and painlessly. I don't know any......

Unfortunately, you can't make your husband do anything.

Try talking to someone on his side of the family if you are still on good terms with them. Tell them what you said here, that you want it to be civil, that dragging it out only makes it worse.

Keep in touch with your lawyer about this. He/she probably knows the legal things you could do.

In the meantime...hang tight! This too shall pass. Your life will only get better. :-)

Call your attorney and ask him what can be done. He can't hold up a divorce just because he's slacking. Ask your attorney to push for a court date.

You are not supposed to GIVE him the divorce papers. You are supposed to have him SERVED by a party who is not involved, he doesn't HAVE, to do anything because YOU didn't have him served properly, he can throw those papers into the garbage because that is all that they are.

If you get a lawyer then he wont be able to ignore you. If he doesnt show up then you automatically get whatever your asking for.
