I have posted a question on here before about what to do with an angry neighbor. Well... It finally came down to a physical confrontation. I was stepping out of my car with my childrens lunch in my hands when I was confronted by my neighbor and her friend. Words were exchanged and she ran up on me and punched me. I threw her to the ground and began to fight back when her friend ran up on me from behind. The friend yanked me back by my hair and held me to the ground while the hostile neighbor continued to kick me in the face. I screamed for my babysitter to dial 911. Once the cops showed up she made up a story about me attacking them. Then she left in an ambulance. Now she is pressing battery charges against me and is going to try to sue me for her hospital bills. She's also trying to get me and my children evicted from our home. How can this possibly be? I'm a young mother of three who was attacked by two aggresive older women and it's my word against theirs...any feedback?

you need to COUNTER claim....i hope you also filled out a police report with your side of the story...need an attorney and press the district attorney to file charges against your neighbor and her friend for battery....

re: her suit for injuries, counter claim her lawsuit seeking your own damages---including pain and suffering....

WOW you have it worse than me, my neighbor only throws spit and insults, but my friend (studies law ) has warned me that even if they insigate a physical fight i can be held in account for assult, if i react with violence. he had told me the best course of action would be to let them continue with the violence, get taken away in an ambulance, then sue for ownership of thier home. seems like perhaps these ppl had legal advice. it sounds like you are between a rock and a hard place I would lawyer up and press assult charges on them. and if your a renter why wouldent you want to move? if you dont move i would spend the $ on a camera system so the next time(God forrbid) you have documentation of what happened, what do you want to bet someone had there cell camera rollin from the time you threw a punch? well good luck ~ peace be with you!

Is your babysitter a witness? Anyone else?

The police will investigate and you will need a lawyer. Counter charge them with battery and sue them for damages. It sounds like you got the worst of the exchange.

Get a good lawyer who will make you both take lie detectors, then when the truth comes out that it was self defensive you can if you choose file assault charges of your own, however if you feel that your safety or that of your children is in danger, it can't hurt to get a restraining order against her and point out the fact that why would you attack them both in your yard, that's a tad absurd.

Well for one was she on your property? For two you have the babysitter and your children as a witness. This girl obviously has it out for you and I would make sure you find an attorney to represent you. She sounds like a b i t c h!! To fight you in front of your children, she needs to learn a lesson and not in love. I hope all goes well for you. Take care and good luck.

I am terribly sorry to hear of this.

Get a lawyer and countersue. Whatever you do, don't lose track of that babysitter. You need witnesses. It's two people's word against yours. I hope you have at least one witness to th event on your side. For a suit to be worth filing, you need at least that much.

What did the babysitter see? She will have to make a deposition (a recorded statement to a lawyer) of what she knows to back up your defense. Did your children or any one else in the vicinity see anything? Otherwise, you don't have much hope.

Ask for a jury trial and stick to your guns no matter what they offer you! She most likely won't win a law suit for her injuries if the case is dropped. You will be appointed a public defender. Have him look up this woman's past history. If she has done this to you, she probably has done it to others.
