He is 18 and I am 23. I am planning to move home to get away from an abusive boyfried. I can not afford to live on my own or I would. My 18 year old brother lives with my mother as well. I am conserned that if he gets into trouble for doing drugs that I can not also be prosicuted. (we live in Pennsylvania)

I don't think you would get into trouble.
Although, if he gets caught, the police may search through your stuff too, and give YOU a drugs test.
If you pass, you're fine.

there's always the danger that someone close to you could get you into trouble as well. I'm not even sure if drugs could be found in the hair of a non-user. I think you could get pulled in if he would use drugs in your car and your car would be impounded. If you are concerned then don't go back home but find a roommate, a friend of your gender you've known for quite some time who is clean and can share costs with you. Sometimes relatives can put you up for a short time (a month to two months) till you can get a job, or go back to school (if you need that to make more money). There are lots of jobs out there right now. I'd be curious to know that since he is illegal why no one is turning him in.

if they know who owns the drugs, they are locked in your brothers room, you should be ok. if they find drugs in a common area, and your brother denies they are his, they will probably arrest everyone. if your brother hides drugs in your room, you could be arrested.

but, the real questions is, do you really want to be siting in your room when the swat team breaks down the door with a tank? or (saw this on cops, it was great) the swat truck races up to your house, 10 cops jump off with chains, hook them to your doors and windows, then drag half your house down the street ?

find another place to live, or turn your brother in and have him arrested before you move in.

you are going to go from the frying pan into the fire. from one bad place to another. living in a shelter would be better. check the phone book. there may be a government agency that will help you find a place to live.
at the very least, seek counseling. abusive guys have to break you to control you. they have to convince you that you are worthless, deserve what you get. until you get into a shelter and get counseling, you wont realize that the abusive ex still controls you.
he cant exist as a man until he destroys you as a woman.

Yes-especially if he sells them from the house. Anyone living there can be charged if caught. I've been in this situation with an abusive ex. and a police officer told me that everyone gets charged because they have no way of knowing who it belongs to.
I lucked out because I had the cops to my house several times and pressed charges on the ex. So they didn't charge me with anything.

yes but only if the drugs were found in your home and he dosen't say that you didn't know anything about it. if he says you knew then yes. and if he says you didn't know you also have to file papers aginst him so that it dosen't help him out eighter in the eyes of the prosicuter and he will probably get a more strict punishment because of you doing so

I live under North Carolina laws and I believe you can only be prosecuted if the drugs are found on you. In any case though, if you have nothing to do with your brothers drug problems then you shouldn't have to worry about any prosecution.

They arrested, convicted and jailed a grandmother in Tucson few years back because they found some weed in her house that her grandson was storing there. I can't imagine the laws in any state being more lenient.

as far as iknow you can be prosecuted for your brother using drugs in the house that you live in....especially if evidence of drugs could be found in your house....advice would be to check with the laws on this in your local area....hope this helps
