my friend was driving a car registerd to me (that i have been letting her drive for the past 5 months) and she decided to go to a pharmacy drive through, say she was someone else, and obtain this other person's pain killer. we know this other person (the one she took the rx from) and the person called the cops. I had no idea she was going to do this, was not in the car, i have no record and i was at work all day (which can be verified).
the person that called the cops knows that i have nothing to do with it but wants to bust my friend. that is perfectly fine with me. here comes the bad part.
i used to buy a few from the person that has the rx, and when they catch my friend, she will try to bring us both down with her. i haven't bought any in a couple of weeks, and my system is clean, the car i drive is clean, my apt is clean and my record is clean.
would what she tells the officer be considered heresay? or could i face charges (with no physical evidence??)

The friend that stole the rx also just came off 30 days house arrest, has a small record, but nothing major. right now though, if she gets caught driving it's a mandatory 30 days for her, let alone what she just did.
so lets say the S h i t hits the fan and they get me to admit i used to buy a few here and there a while back, what kind of jail time am i looking at? i for real had no knowledge that she was going to steal this rx and i didn't know until my friend that owns the rx called and told me. we live in northern ohio. i need to know why i might be facing...
again there is no physical evidence against me for the crime, my system is clean, my records squeaky clean. however, there might be an emial from 6 months ago that my friend might have that says i took some pills (not bought, just took). I'm freaking out!!! What should i do?

Volunteer to take a drug test. That will clear any confusion.
She can point the finger at you all she wants but the facts remain that SHE purchased the drug, SHE got caught in possession, and SHE cannot pass a drug test.
YOU were at work, and YOU can pass a drug test. Case closed.
*Explain to them (if they bring you in) that yes, you did take pills a long time ago but that you are trying to get your life straight now and you haven't taken them in a long time (the drug test will verify this). Tell them that you also thought she had stopped as well and "now this happened....sigh.....man, am I shocked!"

Obviously none of this is your fault! Tell the truth, and nothing but the truth and you'll get off. If your friend lies, then obviously you made a mistake of trusting him/her in the first place. You should go into the cops NOW and give them your side of the story first, with verifications of where you were at the time and your last rx and stuff. I wouldn't worry that much because the person who the rx was stolen from knows it isn't you, but still make sure that they are on your side because you can't really trust anyone these days. :(
Good luck! :D

You are not in any trouble-- at least not legally-- based on all the facts you relate. I suppose it's theoretically possible that your "friend" could say that you provided the car so she could go steal drugs for you, but even then, as long as you remain silent, there would be no real problem for you.
But you should keep in mind that, if you keep buying painkillers, your record isn't likely to remain clean indefinitely.

Just deny it. If possible talk to the person with the rx and ask if they will keep it between them and your friend. Legally I dont think they will both trying to prosecute you with no evidence. This is real life, not Law and Order. They wont waste their time.

You may be in trouble when the police investigate her claim that you bought prescriptions from the same guy. They can not only question and bring him down, but he could give you AND the pharmacy up as well. The pharmacy records could be subpoenaed, clerks questioned etc.
This doesn't look good and will depend on who does what and what drug was involved.

You could always be charged with no evidence, they do it all the time. You should learn from this to be careful of who your friends are. If she got into an accident or committed some other crime in your car you would be responsible as well.

She tells the cops your a junkie...so what. She tells them you illegally ingested anothers Rx.....so what. Your not being charged with anything. Your not the focus of any investigation. You are in the clear. It cannot be proven you ingested the Rx stop worrying.

don't sweat the small stuff-she was in your vehicle and tried to have a stolen prescription filled- obviously "her friend" wasn't happy and blew her in. I doubt that you will be in any trouble, but your vehicle might. Stay away from your friend who you let Borrow your vehicle- be smart, look for a better class of people to hang out with and TRUST, and STOP letting people use your vehicle-you never will be sure what they are doing with it or to it- Wonder if this friend robbed a bank or whatever???Think about it

You need to hire an attorney and explain your situation. you are not going to find the help you need on yahoo answers. call a defense attorney you may even get one pro bono if you meet the guidlines. good luck and if you need to find a good lawyer call a friend or family member for a refferance.
