Okay, my friend was caught shoplifting by a undercover shopper at Wal-mart. I'm not sure what or how much he tried to steal (as i didn't want to ask him) but he said it couldn't be more than $200. He claims as he was caught, he was kept in the back for no more than 5 minutes, in that period of time, police was present, but didn't say anything, also they just took down his information, and was told to wait for a call from the manager (he works there too...i know, idiot)

What do you think is going to happen? he's really scared of getting a record, doesnt care about getting fired or banned

I would expect him to be called in an arrested or told charges are being filed. He will also need to pick up his final check. this why the delay in action so you he can be paid at time of termination. Tell your friend he does not have to sign or admit to anything and should not. They will and can lie to him about what will happen if he doesn't. I would urge him also to talk to an Attorney before his next meeting with walmart. I have experience in this and can help if your friend desires. Tell him to contact me through yahoo answers (PM or email) and I can give personal help

Well I can tell you he will most likely be fired and banned. As for him getting a record...that all depends on if walmart presses charges. Usually a place like walmart will press charges, but if he was a good employee maybe they won't press charges they will just fire him. You just have to wait and see what walmart wants to do. I would guess a first time would be som fines and probation.

They are very likely to have him arrested. If he's offered a chance to avoid arrest, he should jump at it. If he is arrested, and if the amount is under $200, that would be a misdemeanor in most states, resulting in a fine, probation or both. But, these days, it's not good to have even a misdemeanor on your record-- it can follow you forever. Therefore, he should hire a lawyer to help him handle the case in a way that will avoid a criminal record.

What happens now is up to the courts. He will be prosecuted, fingerprinted, photographed and all will be recorded. He could serve some jail time or pay a hefty fine or both. The important thing is to learn a lesson from the mistake and avoid such trouble in the future.
