My leasing agent took late fees out of my rent and is now trying to evict me for oweing partial rent? is this legal?

Yes you have to pay all the rent including late charges.

Yes you can be. In some states you can't be evicted for lates fees..but it all depends on how much it is and where you live. The landlord can always take you to small claims over it. In most states, he can evict. Sorry, your best bet is to pay up to protect you credit from a judgement.

Yes, it is legal, as long as the charges assessed were appropriate according to law. The name of the game is paying your rents in full when due. Any deviation from that program puts you in default, and subject to eviction.
