She runs the school newspaper and we've never gotten along. She has always had a problem with me.
On Wednesday I went home because I was very sick with food poisoning. Only thing was that the paper was set to go to the printers that afternoon, and there was a blank corner in the sports section, which is my section. All it needed was a photo and a caption, and the photo had already been taken.
She called my home to ask why I wasn't at school, and I told her about my food poisoning. She said I had to come to school and finish my section, I told her it would take 2 minutes and anyone else could do it. She said I had to, or she would fail me. She called my mother at work and left her a message saying I was irresponsible and rude and she was going to fail me if I didn't show up within half an hour.
So I had to call my uncle to come pick me up from home and drive me to school (in a snowstorm, no less). I did the picture and the caption in 1 minute and 30 seconds (my friend timed me).

She went up to me and said, "There, now that wasn't so hard, was it?" I said to her, "Can you not see that I'm sick and need to be in bed? I've thrown up 3 times today." She replied "Well, I can see that, that's too bad, but that picture was your responsibility."
I told her next time she would be hearing from my lawyer.

... I forgot to add that I'm a senior in high school.

Yes, five other people went home with food poisoning. It was from the cheap Mexican food we ate at a study night for our College Algebra final.
I am not lying about the sickness.

Unfortunately, you can't sue someone for being a b*tch. The laws are different in each state, but I can tell you with confidence that she did nothing actionable. And you had no "injury," so there would be nothing to get damages for. The closest thing would be negligent infliction of emotional distress, but what you are describing doesn't even come close to satisfying that tort. Best bet - get your parents do go in with you and talk with the principal if this lady is really bothering you. I know bringing your parents to talk to the principal isn't exactly cool, but it will probably put some pressure on the lady to stop riding your ***.

What would you sue her for? There are no grounds here. I think it is hard for anyone to answer this as there is background information that we don't know - ie - do you fake being sick often or shirk your responsbilities on a general basis - meaning have you given your teacher reason to believe that you are not telling the truth?

If it only took a minute, why didn't you do it before you left that day? I understand you were sick, but you also knew they were depending on you, and that it wouldn't take you long. Be prepared because those excuses don't work when you start working instead of going to school.

I wouldn't rush out and file a lawsuit, if you do that the school is likely to try to defend the teacher. But I would daffinately have my parents contact the principal of the school and file a complaint, see what happens with that, if you don't get any results (IE. switched out of the class, an administrator overveiwing your academics in the class, disciplinary action for the teacher for violating your rights) then have your parents contact the school board and discuss the incident and the lack of results from the principal with them.

Go ahead and sue.Be prepared to comed up with a retainer of maybe $ 1000.00 and pay $ 200.00 or more per hour, plus expenses.
Did anyone else go home with food poisoning??? it sounds like yo have quite a track record of going home sick and now you have to threaten them with a lawyer to cover yourself.

Sure sue her why not, she sounds like one of those real ***** teachers on a power trip. Maybe it will help future victims as well.
add- couldn't you sue her for threatening you with your grade?
