Ok, so I own an apartment building in Maine and my issue is that I have a tenant that is also my best friend that recently got with a guy that is now staying with her. He is a registered sex offender, and apparentley a peeping tom too. He has been caught doing it to the same person twice! They called the cops on him last night and there is no peeping tom laws in Maine. The officers said they could go speak to him but it would probably only infuriate him and something bad could happen. Here is my question, what can I do to get him out of the apartment building? His probation says he cant be around kids under the age of 16. I have kids in the apartment building. My current tenants have handed me a petition tonight to have him removed... how do I go about doing it though? and I also dont want to lose the friendship between me and my friend also. I want my tenants to feel safe, as they are all good tenants! please help me!

I dont make my tenants have leases as this is a small area and honestly I have had better luck without them! She is a good person, she just picks bad guys! and no, he isnt steril!

it wasnt the state police first of all and secondly I meant that the officers were afraid that he may try to do something to the tenant... not to the officers... and only for there saftey! My tenants are my priority and there saftey comes first, I realize that I wasnt looking for critisism only wondering if how I could legally go about doing it is all!

There might not be any peeping tom laws in Maine, but I'm sure there is something that has to do with sex offenders. As a landlord, you are obligated to keep your tenants safe. I say, you call the cops once more and tell them that the guy is a sex offender and you want him out and away from your apartment.

Ever heard of the phrase "business is business and friendship is friendship and may the twain never cross"? Well you are going about it wrongly. Firstly, I find it hard to believe that a Maine police officer is afraid about what this weirdo can do. Does that mean they only respond to friendly disputes? Find yourself a Real Estate Lawyer. That person can review your rental agreement to find the legal clause which prohibits the sex offender from living or visiting the apartment. You may have a simple legal recourse in removing both your so called friend and the companion because of a bridge of contract. Secondly, you need to turn this person in to the District Attorney who will have one or both people evicted. Now it is very possible you may lose this so called "friend" but who wants to associate with anyone who harbors or befriends sex offenders. C'mon you're not that hard up for friends are you? Stop lending to, buying from or renting to friends. I have a personal rule I have kept for over 60 years -- I do not sell, buy, borrow or lend anything to or from a friend. Best way to lose a friendship. If they are selling -- I don't need it. If they're buying - I wouldn't sell it to them. If I need a tool they could lend me - I go buy my own. If they are asking to borrow - I always find a way to be fresh out of it or using it and will get back with them (I never do).

You do not have a written lease, correct?

It is very likely that the sex offender is now a legal occupant and will need to be evicted in order to get him out.

Your friend is putting you and your other tenants in a horrible position - that was her choice. She moved in a sex offender. She brought this on and now will have to face the consenquences of her actions.

Regardless of what you try to do or say, your friend is likely to continue to "sneak" him in because she "loves" him - if you allow her to stay.

Here is the rub, it sucks for your friendship, but it is what it is.
You cannot legally get rid of him without getting rid of your friend as well.

You can terminate their month to month tenancy at will with a 30 day notice. It must include a full rental period.

If you give notice any day from now until December 31, they would have to vacate on or before January 31.

If they fail to vacate per the notice, you will have to file for eviction.

You cannot legally evict only one occupant from the premises. An eviction is the landlord demanding possession for the premises be returned to him. All occupants must be named in the termination notice and eviction summons.

In Calif. Your/friend is in violation of the rental agreement. If he is living there and he has not signed a rental agreement. Hand her a 3 day notice to perform conditions or quit.
You could be held liable for your tenants moving expenses if you do not comply with these rules (some friend you have there). They have put you in this position. Ask her to remove the person or she will need to move too. Do you risk losing this type of friend or do you risk your lively hood?

I say, call his probation officer and let him know the situation. Your friend will be better off in the long run and will eventually thank you for it. To make it seem more legal, try telling your gf that he needs to go through a background check and be put on the lease in order to live there.

Your friend is nuts! Check out what the lease says about people living there without being on the lease. You need a better class of friends. Her boyfriend is a perv.

Your first loyalty comes to your tenants not a Friend . He gets kicked out & life goes on ..

To find out where to go, ask someone in the town hall or Chamber of Commerce. If they don't know maybe they can tell you who WILL know. As far as your friend is concerned, make a copy of the petition so you can show it to her when she complains. You know - you are most definitely putting those kids at risk and if anything does happen you will be accused of aiding and abedding.
