The plantiff is asking the state to to enter a judgement to sell my property to satisfy said debt. The debt is an issue and in my opinion needs to be challenged. My property is co -owned with a family member who happens to be an attorney. This property was as part of an inheritence. I have never claimed the title. My partner thinks I should file Bankruptcy. I want to fight! What should I do?

You need to get an attorney right away. If a complaint has been filed, you must answer . . .usually within 20 to 30 days. if you don't you could get a default judgment against you. Bankruptcy works to stay (or temporarily halt) the state litigation and can help you restructure your debt/business. However, you need to have an attorney. . and fast.

If your name isnt on the title then you cant sell it.Anyway offer to set up a payment plan and that will make the judge happy, unless the plaintiff is wealthy and has good connections at the courthouse, then your pretty much screwed.
In the meantime OFFER some payments by sending checks in the mail, send them certified , and also make copies of the checks.This way the judge wont chew you out for NOT trying to pay the debt.

get an attorney on Monday, and not one that has a conflict of interest.

this is the advantage of various forms of incorporation btw, it shields perosnal property from the debts of the business.

But that is too little too late now for you.
