It is possible. Depending on state and federal guidelines. The charge would be "endangering the welfare of a minor" (rape would need to be a sexual act) and you could be charged whether it was consensual or not. Defined by the state a minor has no way of differentiate between right and wrong, so they are not legally able to give consent. You can sit for three to five years for a charge like that so tell your "friend" not to think about it.

You bet! In most states, an 18 year old is an adult and 17 juvenile. Even an 18 year old can be charged with statuatory rape of a 17 year old. And the wider the age gap the more likely the person is to be charged. That one could be good for about 5 years and sex offender registration for life. Only way around that is for the 17 year old to go to court and be declared an emancipated minor.

States vary though. It's about a 50/50 split whether or not the statuatory rape statute applies.

Yes. The 28 year old is an adult child sexual abuser...the 17 year old is a minor...and a minor cannot consent to sexual contact.

Tell your friend to go find some grownups to play with and leave the children alone.

Depending on the state, yes and no. Some states have a legal age of 16 and still others have a legal age of 17. I somehow don't think anyone would care unless you cried rape

I hope so i was willing at 17 but i was very emotionaly immature and dirty old men took advantage of the fact that i (never knew my dad) was looking for a mans love & approval
