Did he leave a will? If so it controls. If not, most states allow assets to go to the surviving spouse, but you must file a Petition in Probate Court allowing distribution of assets. If your sister somehow has access to his money instead of you (?), request in your Petition for an order to freeze his bank accounts pending resolution of the Petition in Probate Court. You cannot be "erased" as his spouse and legal beneficiary. File the Petition in Probate Court AS SOON AS POSSIBLE! Do some calling around for an attorney. If you can't find an attorney, go do it yourself, they have blank forms for you to file; its better than doing nothing and letting it all slip away!

first, Johnnie Cochran is dead. as to getting a lawyer on contingency, have you asked any? If you call lawyers in the phone book, maybe 1 will take your case. you probably should concentrate on those who handle "family law" or "trusts and estates". If that doesn't work, and if you have a low income, you might try looking for legal services or legal aid in your area. Or if you live near a law school, find out if they have a clinic aiding local residents.
