Hey the chimney is cut into the eve of the roof and when it rains it is leaking into the attic and into the living room ceiling. Do I need new flashing or is it coming from the inside of the chimney?

It's definately A flashing problem..if it is dripping from inside..then it would be showing on the inside where you put wood....if you see it from the attic..then it is the flashing....

Yes it sounds like a problem with the flashing. If water were entering the chimney and getting into your house you would have other problems like smoke from the chimney getting into your house.

A lot of so called roofers out there that don't know how to do flashing properly.

The fact that it is at the eave, it's receiving all the rain that the roof picks up from peak to eave. Best place for chimney to terminate is at ridge, minimal water flow from roof hits chimney. Your problem definitely sounds like bad flashing. Check flashing at high side of roof and look for gaps. A "cricket" could be framed at the high side to divert water around chimney. I found an example of cricket and roof flashing with a quick Yahoo search.....

If your talking water coming down the chimney a cap will work and is a simple install. If your talking smoke leaking into the house you may need to clean your chimney in order to achieve adequate draft.

You can place a cover on the top of your chimney.
