I am a realitor, I had a job for 15 years, the company went under. I recieved my realitor licence last year. I have never sold a property yet. I went on unemployment because I cannot pay my bills and could not find a job during the holidays. I have seen temporary employment during the holiday, but it will not cover my expenses. I was working for the same company for 15 years. I cannot find another job that will pay me the same.

My question is; Is it fraud if I collect unemployment while I am a realitor, untill I sell a property to get back on my feet?

If you are actively working at being a real estate agent, under a broker, you are working and you would be committing fraud. The fact that you are chosen a commission only job does not effect the fact that you have a job. You are warned.

Most jobs require you to be able to spell the position. If you are in a position to be able to sell a house, you ARE working. Just because you are not good at it does not mean others should support you until you get it right. You also need a certain amount of time working and investing in unemployment to collect it.

No, it's not illegal to work while collecting unemployment benefits - as long as you report the income you are receiving to the unemployment office.

Your benefits checks will be reduced a percentage based on the money you make at a job.

If you don't report earned income, and they find out, you will be required to repay all of the money you received from them...and you can be charged with fraud, taken to court and be sentenced.

First, you have to spell realtor correctly.
You'd have to call the unemployment office and check. It depends what kind of pay arrangement you have with the realtor's office.

Depending on what state you are in, you can collect depending on why you were fired. If you are fired without being given warning and/or reason, you can collect. You can also quit and collect in certain circumstances but it is very difficult. Typically it is just if your company is going about things illegally/illegitimately or you are in an unsafe or threatening environment. This happened to me and it is very difficult to collect because I had all of the above and surprise, they lied to get out of the situation. But it can be appealed. I got letters of reference from coworkers who were willing to speak out or left the company, previous employers, character references, etc. I also had documentation of things that happened at the company. The only reason I didn't go through with the appeal was that I had a family member working at the same company who I was sure would be retaliated against (and was). Depending on your reasoning for needing to get out, call you employment security/unemployment office and contact a senator.
