Yes its stupid, but about the worst that can happen is that the judge will order them not to throw the ball back into the mans yard. More likely the case will be thrown out by the judge as frivolous.

Yes, this is stupid unless the man suffered damages as a result of the ball entering his yard. I don't think he'll be able to successfully argue that there was any kind of actionable tort. And depending on the state, it is possible that your neighbor may be able to recover any legal fees incurred if the suit is found to be frivolous in nature.

Did the ball cuased any damage, like hurting someone or breaking something? If the answer is yes, then he can sue and win. If not at most all he can get it's an apology and keep the ball.

unless there is more to the story... is that even possible? That is ridiculous unless there are many other times something else happened. Might just be war of the neighbors and they are trying ANYTHING to get the other in trouble? or one sided? Yes- from only what you say.. that is stupid.

I think he only has grounds to see if some sort of damage was done, but i think he's doing it to scare the kids...a waste since he has to pay for court fees and stuff if the court even hears it

It is stupid if he has no damages. But if they accidently threw a ball in his yard and broke a window that they won't pay for, he is right to sue.

if there were damages and no agreement between parties involved, it could conceivably go to small claims court. otherwise,a good, ethical lawyer wouldn't touch it with a ten foot pole.
