If you didn't care enough that your girlfriend is expecting your child, why should the judge care? It obviously wasn't important enough to keep you from (allegedly) committing the offense.
I really doubt if he or she will cut you a break because you're going to be a father.

No. You'd be surprised how often this happens. It will not have any effect on the judge. But your lawyer could argue it in mitigation by saying that you were truly sorry for what you had done and recognised that it was irresponsible behaviour, particularly because you were a man with family responsibilities, and that part of your punishment might well be to find yourself deprived of being presentat the birth of your baby. The judge will be a lot more impressed to hear that you are planning to get your act together and sort your life out so that you can be a good father than to be subjected to a lot of sentiment about the baby's birth.

Why the hell should it make a difference? Do you think that they let soldiers come home from the front line just for the birth of their child? No they do not! You sound like quite the coward. You did the crime now do the time. Just one question who shall be supporting your girl and child whilst you are in the joint? The poor tax payer is probably paying. If it were up to me there would be no welfare and prison would be HARD TIME.

If the Social Services knew that you were going down for ABH, they would almost certainly oppose any contact; they would be considering the risks of exposing a baby to a man who is known to be physically violent; too many babies have been harmed and killed at the hands of a putative father.

No they wont release you for the birth, and it is highly unlikely that they will not send you to jail just because your girlfriend is expecting, you could get your solicitor to say that you want to turn your life around and make a fresh start for the babies sake and be a good father, but it depends on the judge, whether it'll work. It's quite possible you won't go to jail for ABH. My mate Meat (so called due to being hung like a bloody horse) and his brother filled in a guy who'd punched his brother's wife in the face. They both got charged with ABH. Meat got a two thousand pound mine, his brother got fifteen hundred, and they both got given a six month suspended sentence.
Not knowing the details of your case means no one on here can offer a reasonable bit of advice. Talk to your defence. Whether he or she is court appointed or not your solicitor will still have a good idea of how likely a custodial sentence is. It will all depend on previous convictions, actual damage done to the victim etc.
But don't plead not guilty. You'd be going to jail if convicted. It's in your best interest to take the hit, whatever it is.
And keep your nose clean, mate. You don't sound like a complete knob to me.

It sounds as if you may already have legal counsel. These are the kinds of questions that you need to ask them.
If you have no legal counsel, then you are not set up well enough to be around a mother and a new born. Give this some thought.

definatly not. the law looks to punish people for the wrings that they do. ABH is a serious offence and if the judge knew you wer expecting, he'd probably use it against you and say you are a potential threat to your unborn child. be careful

in-maturity getting a girl pregnant and not being married. If you assaulted you should face the penalty. Are you kidding they don't release people out of prison for anything including death.
