1. Is it illegal for teahers to confiscate cellphones, ipods, etc, for more than 24hrs?
2. Is it illegal for teachers to look through the files of your cellphone, during the time it is confiscated?
3. Are we (Students, K-12) allowed to take legal action if it is confiscated for more than the period of 24 hrs?
4. Please tell your experiences like this. I need information on this. If it did get confiscated, when did you get it back?
5. If a teacher looks through a confiscate dcellphone, ipod, ect.
Are they violating a citzin's privacy rights?

Those are some pretty serious questions for a 6th Grader. Don't worry yourself over it, your in no position to be taking legal action, this one will get sorted by parents. Just keep your phone off during lessons or on silent, you don't need it on in class and you definitely don't need your ipod. If there's something on your phone or ipod that shouldn't be looked at, you shouldn't have it anyway. When you get it back, just be more careful next time kid.

1.Well at my school the policy is they can keep it until a parent comes home and picks it up. Most of the time teachers give it back at the end of the period but occasionally you get a real nasty tecaher that acually does the policy.
2. i think its illegal to look through but if its during a test i think i teacher has the right to look through a text message or things of that nature to deterime if you were cheating or not.
3.You could take legal action for anything if you really feel it is nessecary
4. I got my phone taken away for the rest of the period. My teaher is nice and im a good student so it wasn't a big deal.

they can confiscate for as long as it specifies in the school rules.
if your parents gave you that cellphone and told you that you could take it to school, in case of emergencies, then i don't see why it's wrong to take a cell phone to school.
however, there are rules to follow. Unless it's an emergency, you really shouldn't have your cellphone out.
if a teacher specifically snoops around your stuff to find a cell phone and it's not just out in the open, then they are in the wrong. that is violation of privacy.
and if they search through your phone then that's a big no no. they have the obligation to turn it off when they confiscate it. it's not their place to invade your personal life like that.
perhaps you should get your parents to do something about it.
Georgia seems to have a problem with teachers like that though. it's the same situation where I live. here, they keep cellphones for up to 30 days.

Since you are a minor, who can not sue/etc on your own, you are not yet really a citizen. The school has no right to confiscate cell phones, or open files, etc...but can ban them, and expell anyone who brings them to school. If you get technical enough to start trouble, and try to get your parents to sue, or bring criminal charges, the school may get technical too. How popular will you be if NO ONE can bring their cell phones to school at all, EVER, because of you, and if those who do bring them get expelled, and have to take the year over? You are on the losing end of a very short stick, so take your lumps, and suffer in silence...unless you want lots more lumps, and no friends.

i'm gonna email you right now.
this is what i wrote in it:
umm, here in ontario canada, a kid got his cellphone confiscated by the principal (this is in like grade 10 or 11 by the way) and she went through the videos on it and there were many "innappropriate" videos on it and she suspended him for them for 4 days in school.......
the 2 sides is that hew was playing with it in class and another student ratted on him because she saw some "inappropriate" content on it and the teacher took it from him and gave it to the principal, who then went through it and located the videos.
the other side to that is that the volume was not up at all, and what one has on their cellphone is ONES' buisness - - not the friken' principal's.... if it is taken away that's one thing, but going snooping through it should be considered a violation of privacy.
however it is not - because take the case of a student reporting to a teacher that another student has drugs in their locker. the teacher is going to get the principal involved and she is going to either have the student unlock their locker or have the lock cut off... if there is reason to believe that unacceptable things are on or in school property, action is ALLOWED to be taken.
like smoking is NOT allowed on the premisis, if you are caught smoking on the lawn of my school, you are hauled in and suspended. however if you were to smoke just 1 feel away from the lawn - on the sidewalk directly beside the lawn, you are safe. if a teacher sees you smoking on the SIDEWALK they can't do anything about it, but if they found out that you had cigarettes in your backpack they'd suspend you.

over 24 hours, no i don't think that's right. i think if you need to you tell one of your parents that your teacher has had your cellphone for [how many ever days she's/he's had it for] and most likely if they were the ones that payed for that phone they'll do something about it. go to the principal possibly? if all else fails go to the board of education and get on their backs about it - tehy don't like having people on their backs about things so they do their best to take care of your problem right away.
they seem to be about the only thing that is even remotly right about the education systems today.............

Federal law says your rights as a student are limited by in loco parentum, or in place of the parent, which means the school takes (with limits) the place of the parents when you are there. As long as your cell phone is off and not disturbing the class, nobody can take it away. If it is on and disturbs the class, the teacher can take it away.
Teachers shouldn't look through phones, but if you have been a disturbance in class you are running the risk of losing constitutional protections.

YES. OF COURSE IT IS ILLEGAL TO GO THROUGH SOMEONES PRIVATE PROPERTY WITHOUT PERMISSION. ARE YOU STUPID?
how could even think about going through a students personal ipod, phone, etc. without permission AFTER you take it away? what is wrong with you. and yeah the rules are
1. if you take a phone away, you HAVE TO give it back to student after class/school or bring it to the school office.
2. you cant just hold onto it for whatever amount of time you feel like. i mean what are you going to do with it for 24 hours?
you certainly cannot leave it in a classroom overnight and you CANNOT TAKE IT HOME WITH YOU. ITS SOMEONE ELSES PRIVATE PROPERTY. THAT IS CONSIDERED STEALING.
thats what you should tell your teacher. im in 10th grade and ive had my phone taken away all the time so i know how fustrating it is. i would be FURIOUS if my teacher started going through it reading my texts ect.

everyone has a right of privacy...therefore, teachers should not be going through the files on students' cellphones or other electronic devices.....whether this is illegal or not, i couldn't tell you. i've never been to Georgia, regardless of whether you mean the country or the state.

Teachers dont have the "right" to confiscate anything. If you have to bring that stuff to school, dont let them know you have it. But if they find out, then just refuse to give it up. Dont let them bully you. You may get a detention or suspended, but thats what happens when you stand up for yourself. Dont let them bully you.

If you broke a school rule, the teacher has every right to keep your phone. Next time, when they mean. Turn off your phone, or leave it at home-THAT'S WHAT THEY MEAN.
Adults don't talk just to hear themselves speak.
Leave the phone at home. That way you'll actually learn something useful. and by the way in school-you have no privacy. It's school; not 'I do whatever I want place'.
leave your sh*t at home kid.
