the service department even said they took it apart, including the back seats
Am I within my legal rights to ask for a new car to replace this car, even if they "fix" it, now that it's been disassembled and re-assembled?

"Including the back seats????" Hmmmm.....I have to wonder why removal of back seats has anything to do w/ the car's normal operation. I also wonder what the statistics are out of 100 factory assembled cars made, there is/are "lemon(s)". Evidently, your car sneaked past "quality control" and is clearly the proverbial "lemon".
Some states have a "lemon law", that protects car buyers from those vehicles better suited for the salvage yard than one's front yard; even the "sold as is" sales agreements don't hold well against the "lemon law". Within the "lemon law" is a "disclosure clause"; self-explanatory: the seller must honestly tell the potential buyer EVERYTHING known to be wrong w/ the vehicle.
Check your state's laws for such auto buyer protection laws--but do hurry; there may be 30, 60 or 90 day from purchase legal time constraints involved, don't let time run out!!!

What kind of car is it? Some car companies allow for their customers to return a car within a certain amount of time. Can you give us a little more information?
Also, just something to think about: If you had the option of getting a new car (the same one you have) would you really want that car if you had problems right away with it? It might not be very econmical down the road and may give you more problems than it's worth.

If they have fixed it, then no, you aren't within your legal rights to get a new car. You may be able to file a civil suit and convince them to give you a new car, but to walk in and say, I want to trade you mine for a different brand new one....no.

I think you should take it somewhere else ,because if they start on the backseats to fix a car broken down they are lost from get go , Personally when I fix a car I usually start at the engine .There is a lemon car clause ,to check out also. Also buy north american ,ford gm ,you know , the stuff that keeeps people in jobs on this north american continent.

Nope. It has to be in the shop three times for the EXACT same problem, before a lemon law can help. Sorry, but that is the law handed down our Federal government.

I think there is a lemon law, but you have to take it back for the same issue like three times and they still not fix it.

It will fall under the Lemon Law of your state, IF they cannot repair it in 3 attempts.

It depends. If it broke down and you're responsible, i don't think you can. But you have an insurance don't you?
If it broke down but it's not your fault, then the guarrantee should fix it or even replace it.
