Most people assume that just because his name was on the Mitchell report that he's automatically guilty of using performance enhancement drugs. In reality...that's hardly the case since he was never given a fair opportunity to make a defense for himself. Furthermore, the only evidence they have against is testimonial evidence which isn't nearly enough to prove beyond a reasonable doubt that Clemens is guilty. The only problem is if he does contest the allegations, then he could further incriminate himself. So what should he do now that his legacy is at stake?

If he didn't do it, then he should sue Mitchell for slander...
If he did use it... Then just keep quiet...

There is such a thing as Discovery if he elects to fight the report in court & everything within the realm of his baseball career and possible use of steroids becomes fair game. Clemens has to prove malicious intent/the accusations were false, but I am sure he doesn't want to go there. In those cases, attorneys have subpoena powers and the power to force people to testify - or face court sanctions - and that alone (more testimony by other witnesses) - in my opinion - would demonstrate that the report is 100% correct .

That is why you hear so many athletes (David Justice, Marion Jones, Rafael Palmeiro, Barry Bonds, Mark McGwire, etc.) make public statements ripping "allegations," but will never, ever take it to the courts. There, it would be proven that they are the liars, pure and simple.

And what gets me is these players named had the opportunity to talk with the Mitchell Commission, and the vast majority refused (basing it on flimsy technical grounds). If you have nothing to hide, don't you think they would have been proactive when the commission was compiling information.

Clemens has one other option.....pull a McGwire, fade away and hope the storm will eventually blow over. I feel he will do this.

George W. Bush's refusal to veto spending and refusal of the GOP Congress to rein in government is the main significant reason they many Republicans are disgusted with them. we are putting aside ourselves from that and helping McCain and Palin. McCain and Palin the two have long histories as financial conservatives. Obama has an rather shaky and short record and this is all tax and spend. I think your statement is well thought out and correct. I agree that if Clemens is innocent of all the allegations then he and his legal team should fight back.

I've been reading the Mitchell Report (I downloaded it) and the is nothing but innuendos. I have yet to see one piece of solid evidence.

I was listening to David Justice and his comments last night on ESPN. He went ballistic. After listening to his comments I'd have to say I believe him. There is no question that he is going after the report and this is what everyone else needs to do if they are truly innocent.

No, he won;t win.

And he did it.

Come clean dude, it takes the wind out of everyone's sails. Look at Shefield and Giambi who admitted what was in the report before it came out and look at Barry. Those guys are big names too, and everyone just kindof said oh, lost a little respect and maybe drops a roid joke, but largely the public does not really don't care.

I think he will be like Palmeiro when he threatened a lawsuit against Jose Canseco for implicating him in his book as a steroid user. Palmeiro talked a lot of crap and made a lot of noise but never filed a lawsuit, gee I wonder why? Time will tell if Roger takes any legal action, if he does it will leave him wide open for closer scrutiny and his dirty laundry will be out in public for all to see.

Let it go, Roger. Anything he says is going to be disected publicly by anyone and everyone. Mark Maguire pissed folks off by refusing to even discuss it. Let history and fans judge what can be proven after the fact. MLB just got caught looking at a 3rd strike. Clemons, nor Sosa, McGuire, etc, owe the media nothing. They should be accountable to fans, but I don't want anyone pissing in a cup for me, thank you.

He's not going to contest anything. He know's it's true. It's been suspected around baseball for years, and now it comes out.

Why do you think Petite hasn't said anything. Yes, the lawyer said because he is still an active player. That's bull. If it's not true, he would have come out long time ago and clearly denied it.

If Roger wants to clear his name there is only one way he can do this! he would need to take a lie dector test! Plain and simple! I just read David Justice is going to fight this and clear his name!

we'll know if roger is innocent or not by seeing if he sues anyone. if he does, then he must really think he is innocent or thinks he has a really good lawyer. if he doesnt do anything about it and doesnt speak out personally and just has his lawyer do it, then hes probably guilty.
