my husband and his mistress has cause me to become seriouse depress and i am also pregnant with his child. he lives with me and me and his daughter to and he has the nerve to be haveing an affair with this women. it has been going on for a whole year.

Kick him out. Then call a divorce attorney. If he refuses to leave the divorce attorney can have him put out. Why are you pregnant if he has been carrying on for a year? Make sure your OB/Gyn tests you for STDs.

Your best bet is to file for divorce immediately! Take him for all you can - house, car, money, child support (daughter and new baby each until they are 18). The only charges you can file are for domestic violence if any, including verbal abuse, threats, and especially if he has touched/harmed you in any way - then IMMEDIATELY file for a temporary restraining order (TRO) to stay away from you and the house. Let him go live with his new mistress. With your situation, I'll bet there's been a few arguments which amount to verbal abuse against you. File now, or you won't have a leg to stand on when he files for divorce first, gets a TRO against you for throwing a paper cup or something at him, and you can't return to your own home! Protect yourself NOW!

Many years ago there used to be a cause of action called "Alienation of Affection" and either a H or W could sue an outside who started an affair with their spouse claiming the outsider was "wrecking the marriage". No longer can such a suit be brought. Now, if someone is calling you at odd hours, or calling and hanging up or leaving nasty messages on your answering machine or sending bad mail or things like that, it is possible to go to court and get a court order prohibiting such conduct. You probably start such an action by calling the City Attorney or District Attorney in our city and asking where and how yo make a complaint. You will run into some resistance from the attorneys office when you explain the relationship of the parties but persist and see if you can get somewhere with this. Good luck.

You probably don't have much of a cause of action, but there are some cases out there in some states regarding wrongful interference with marriage. I would not bank on getting much out of this type of civil action, and adultery is only a criminal act if the person is in the military and subject to its criminal code.

Sounds terribly sad what he has done, but the courts are not a good place to seek resolution as there is no real remedy they can provide.

What you can do is dump him, make his life miserable by making him pay the highest amount of child support. If he can't meet his obligations with respect to child support they would put him in jail for you. Another thing you can do is find one of his good looking friend invite him over right before your husband gets home and act like you are engaged in having sex with his friend by putting your face on his lap as soon as he walks in. Sorry I'm not trying to be disgusting, I'm just trying to give you some ammunition so you can fight back. I can feel you pain. Again if I was you I would start filing for child support right now, because he is still living with you. Good luck with whatever you do....

too bad you can't file charges. I say you not let this idiot make you depressed. Show him women don't nedd men! Show him that you are strong and can make it on your own (or with someone else)!

Don't waste your time moping....He's not worth your tears. Trust me, I know.

It is NOT against the law to....

-Cause you to become depressed
-Impregnant you
-Live with you and his daughter
-Screw another broad

File charges for what? No laws were broken, just your heart. Kick the bum out and be done with him.

i believe you can divorce him for adultery and get alimony and thats it. i dont think there are any laws against what they have done unless they are harassing you but seek legal aide and they can help legally. hopefully he has some money otherwise cut your looses and look toward taking care of the baby and yourself! sowry. what a sleez balllllllllll

None, sorry it is not a crime to have extra-marital affairs. However, you should divorce him and take everything he has ever owned from him.
