okay my friend paid for a week at a motel and on night one he gets arrested (not at the motel) and he will be staying in jail and not at the motel do they have the right to with hold his money and not refund it back since hes not staying there... plus they wont let us get his person things outta the room... my little sister has poa over him while he is in jail...

Yeah. Most rooms have a clause in the contract that once you sign in, you have to pay for the entire reservation. More importantly the clause has to do with not getting a refund in the event of cancellation.

So yes, the motel can hold and keep his money.

Unless you are his immediate relative or that he has given you WRITTEN consent, the motel will not allow you in his room to retreat his belongings. What if you are a thief instead? That's liability for the motel and they don't know whether you really are his friends or not. His parents, brothers, sisters, or attorney are the ones who can retreat his belongings.

Does the Motel need to refund the money? It depends. If he got the weekly rental rate, then probably not as they expect you to stay there for a week. If it reserves the room on a daily rate, then he maybe able to call to cancel the rest of the nights and get a refund. But that is up to the Motel and you have to read the contract. However, someone still needs to get his stuff out first. He is the one who needs to make the call to the Motel, give you his written consent and / or tell his attorney or public defender his situation so that they can get his belongings.

Also, when you say jail, it sounds like he has been convicted by a court. Unless he has committed some serious crime, they usually book you and get you a bond hearing quickly. If he can post bond and get out, then he can just deal with the motel himself.

Yes, they do. He paid for a week in advance, it doesn't matter to the hotel if he actually stays there or not. The only way he could get his money back would be if they rent the room to somebody else during that week.

Make a reservation and not show up? they can charge you for the entire stay. And your credit card company will do NOTHING about it.

The really nice ones will refund the money.

The ok ones will give you vouchers good for 1 or 2 years.
