Ex had R/O for D/V and vacated in settlement, it was bogus to begin with, only a ploy so I could not recieve any spousal support., (this is in Cal.) now that R/O is vacated can I go back to cour. Ex makes 3-4 times my salary we were married 20 years

My suggestion would be since there are minor children involved would be to get higher child support payments.

Did the court reserve jurisdiction over the issue of spousal support, or did they just deny the spousal support? If spousal support is denied in California, you usually cannot reopen the issue later. If you can prove that the RO was issued just to prevent you from getting spousal support, you might have a chance, but short of him admitting it in open court, the chances are slim. Apparently the court considered the issue valid enough to issue the restraining order, even if it later vacated the order.

Also, if you are working, chances aren't real great for the court to reopen the matter. If you were unable to work, maybe, but if you are just trying to increase your standard of living by getting money from your ex, probably not. As long as you can support yourself, you will be expected to do so.

Usually spousal support is not one of the areas the courts will allow an ex to take their ex back to court on but if you can show false pretenses it might be allowed. Good luck
