I have recently purchased a cell phone from a guy on ebay. He sent me a tracking number from USPS but when I enter it it says there is no such item. If he doesn't ship the item how would I go about sueing him? This was like a $250 dollar phone for christmas and this is bull if he doesn't ship it. He has like 98.9% positive feedback though. I'm going to wait about 2 days until I take action, I just want to know how to do it? Thank You

yeah i already emailed him cuz i thought maybe he just entered it wrong, I was just gettin prepared for the worse. Now if I sue him would I get more money back then what it cost to sue him?

Use the dispute/problem resolution procedure thru e-bay. If that doesn't work & you paid with pay pal, you can make a claim under their protection plan. If seller is in another state a $250.00 suit isn't worth doing because you have to sue
in its home state.

Did you pay for it by paypal? If so, they have buyer protection and you can enter a claim. I did for an item that I hadn't received in a month and got it. Contact the seller first though to see what's going on, he may just take a long time to ship. Another good thing to remember is 98.9% may sound good but if its 500 negatives out of something that's a good sign to stay away.

How long ago did he ship it and from where to where? USPS tracking is a joke. You are lucky if they get the tracking done a week after the item is delivered. Instead, contact the seller and ask him about it if you are concerned. Most EBay sellers are honest and fulfill their commitments. If he doesn't respond, file a dispute with EBay.

It will cost you a lot more than $250 to sue the guy. Contact and lawyer and let them know what is going on. The lawyer will tell you how much you need to pay to sue the guy. The lawyer will probably also know exactly which agencies to report the guy to. Like I said, it will probably cost a lot to sue.

Also remember, there are ways to report the guy thru Ebay as well. Their livelihood depends on the sellers delivering what they promise. Report the guy to Ebay.

Uh..Dont jump to conclusions. Email the seller and make sure he has sent it and make sure he correctly entered the tracking number. It may have been just a simply mistake.
My experience with ebay sellers has been, if they are scam artist, they wouldnt even bother sending you a tracking number. They would just take your money and run.

Go to Ebay's home page..there is a place to click on for "disputes"....do that...they will assist you.

Never, ever buy anything on Ebay without purchasing the insurance.

If you paid through Pay Pal they are very good at putting pressure on sellers. So is eBay. Turn him in. Have you emailed them?

I you collected payment and did not refund the money you could be sued. If you just failed to complete the transaction you are fine. The probability of you being sued is very slim. If you where you could go to court and say you where a minor and you would be fine.
