Because the congress in its wisdom has made it an illegal substance and the people of the U. S. have not insisted otherwise. The affirmative statements that you have made are neither fact/true nor well written. Try checking your spelling. Its right at the top of the data entry area. Both tobacco and alcohol are legal substances albeit questionable. Within the week further research into marijuana use has shown that it does significant harm when used in excess. To say that anything bad is legal should never be a reason to make another bad substance legal. Maria Juana has been shown over and over to be a bad substance. Its medicinal value ought to be explored and either debunked or proven scientifically. Until that happens, leave it where it is.

In addition to the taxation reasons, Marijuana will never be legal until there is a way to test if a person is CURRENTLY high on the drug. With alcohol, the limits can be regulated with breath or blood tests. This way the authorities can determine if the amount in your system right now is enough to impair you. With MJ that is virtually impossible. One can only be tested for traces of THC in the system, which could have been ingested 1 hour to 1 month ago. Love the airplane pilot example- but you wouldn't see a pilot with a bottle of Jack, the same way you wouldn't see them with a bong (if it were legal.)

El-oh-el to the comment above mine about it's effects being worse then alcohol and addicts not wanting to admit to themselves. That's as bad as the propaganda from the Reefer Madness. Anyone who has ever smoked marijuana can tell you the effects are less intoxicating then that of alcohol and there's no actual scientific link to show marijuana is anything more then psychologically addictive, mainly headache, insomnia and boredom. Alcohol on the other hand has millions of alcoholics out there and when people are physically addicted alcohol withdrawls are one of the few drugs that can actually kill a person.

there is no money to be made by legalizing it, because you can't tax it....you can't tax it because if it were legal you couldn't sell it, and the reason you couldn't sell it is because everyone would just grow their own so it would be a worthless commodity.
Most people aren't aware that the biggest lobby against legalization is big tobacco....they see marijuana as a safer nonaddictive alternative to their own product. Legalization could cost them billions per year. They actually lobbied for prohibition in the first place...with the help of the federal gov. they successfully demonized marijuana users...

I'm not 100% sure, but I think I read once that it had something to do with the cotton or paper (from trees) industries back when they made it illegal. They didn't want hemp to take over the cotton or paper markets, which were strong lobbies back then.
