Applied for early job pension due to early disability as stated in pension agreement. 12 months finally got them to send claim forms after contacting labor dept. Completed forms and 60 days later still no Answer ? Called and get blown off ? this is a huge amount of money how do I sue them when civil court NY allows only up to $5.000 only? I have all documents in my favor signature card receipts etc Thanks

Short answer -- yes and you need a lawyer who specializes in these types of claims to review and handle your case.

Yes it will cost money, but if the employer is in the wrong...in NY it may end up coming out of the employers pocket when the case is finally settled. If you are in the wrong the lawyer will likely not take the case...esp. if the $$$ are in fact "huge."

Contact the Department of Labor in your area. It's better known as EBSA which means Employee Benefits Security Administration. They are the ones who go after employers and it doesn't cost you a dime. Good luck.

$5000 limit sounds like small claims court, not civil court - you'll have to get a lawyer involved probably
