A restraining order is temporary (TRO), until the court hears the case with both parties plaintiff & defendant present. The TRO usually expires in 20-60 days unless the plaintiff requests a permanent order (protective or injunctive) after court hearing, which may last for years after trial. A protective order can also be issued to prevent discovery attempts, to protect a witness, prevent liens against property, and many other reasons, ie., for what ever needs protection.

If she has filed the order she should not be in problem if she chooses to break it--yet she's making a extensive mistake if she does. The restraining order replaced into placed into result to guard her from this guy. The court docket equipment won't take her heavily if she intentionally places herself in place to be close to him.

They are basicaly the same. Both are to keep you away from her. If you were to move in with her after she filed the order, then you should have had her to go an release it. If not, she can always come back to place you in violation. It is on your hands if she did not do so. You knew the consequences before you moved back in with her.

Have your wife contact your local court and lift the order so you do not get into trouble. I hope for what ever reason it was put into place, you have learned not to do what ever you did that ensued the order. Love her and make it right. If you do, prison is in your future, God Bless and take care.

She still needs to rescind the restraining order or you could be arrested for violating the order. I wouldn't be caught anywhere near her until she rescinds.
