no, not if you save the broken disc, that's the proof you own a copy, if you throw that away then you have no proof you ever purchased it

under the "fair use" clause you are allowed to make personal backup copies, that is what you are doing since you own a copy regardless of it's condition

Whenever I buy a cd I load it in my computer and make a copy for the car and the house. The original goes into the storage cabinet.
